1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Casinova Lounge, developed by Eugene Van Die (Agriventures Holding B.V.) ("we," "us," or "our"), governing your use of the Casinova Lounge mobile application (the "App").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the App.

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting. Your continued use of the App following the posting of revised Terms means you accept and agree to the changes.

2. Eligibility

To use the App, you must:

• Be at least 17 years of age
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the App under applicable laws
• Have access to a compatible iOS device

By using the App, you represent and warrant that you meet all eligibility requirements. We may require verification of your age or identity at any time.

3. Social Casino - No Real Money Gambling

This is a critical term that you must understand:

• Casinova Lounge is a social casino app intended purely for entertainment.
• No real money gambling takes place within the App.
• You cannot win real money or any prizes with monetary value.
• All virtual currency, coins, chips, or credits in the App are for entertainment purposes only.
• Virtual currency has no real-world monetary value.
• Virtual currency cannot be exchanged for real money, goods, or services.
• Success in the games does not imply future success at "real money" gambling.

4. User Account

When you create an account or profile within the App, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your account credentials secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms.

5. Virtual Currency and In-App Purchases

5.1 Virtual Currency

The App may include virtual currency (coins, chips, credits, or similar items). You acknowledge that:

• Virtual currency is licensed to you, not sold
• Virtual currency has no monetary value outside the App
• Virtual currency cannot be transferred, sold, or exchanged
• We may modify, manage, or eliminate virtual currency at any time

5.2 In-App Purchases

The App may offer optional in-app purchases for virtual currency. All purchases are:

• Processed through Apple's App Store
• Subject to Apple's terms and conditions
• Final and non-refundable unless required by law
• Completely optional - the App can be enjoyed without purchases

6. Acceptable Use Policy

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the App or its systems
• Use cheats, exploits, automation software, bots, or hacks
• Modify, reverse engineer, or decompile the App
• Interfere with or disrupt the App or servers
• Harass, abuse, or harm other users
• Create multiple accounts or false identities
• Buy, sell, or transfer accounts or virtual currency outside the App
• Use the App if you are under 17 years of age
• Violate any applicable laws or regulations

7. Intellectual Property Rights

The App and its entire contents, features, and functionality are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial entertainment purposes, subject to these Terms.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the App without our prior written consent.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of information
• Warranties that defects will be corrected

Your use of the App is at your sole risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or goodwill
• Any damages arising from your use or inability to use the App
• Any damages related to unauthorized access to your account

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for in-app purchases in the past 12 months, if any.

10. Indemnification

You agree to indemnify, defend, and hold harmless Casinova Lounge, Eugene Van Die, Agriventures Holding B.V., and their officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the App, your violation of these Terms, or your violation of any rights of another party.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the App will immediately cease
• Any virtual currency or progress in your account may be forfeited
• We are not liable for any loss resulting from termination

You may also discontinue use of the App at any time by uninstalling it from your device.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class actions.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy and End User License Agreement, constitute the entire agreement between you and us regarding your use of the App and supersede all prior agreements and understandings.
